Introduction
Welcome to Crux (operated by Lyxel & Flamingo). These Terms & Conditions (“Terms”) govern your access to and use of our website (crux.lyxelandflamingo.com) and the services (the “Service”) we provide, including software, analytics, and optimization tools. By placing an order or using the Service, you agree to be bound by these Terms and the Privacy Policy.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Definitions
- You / Customer / Buyer: The person or entity using or purchasing the Service.
- Service / Product: The software, analytics platform, features, and related functionality provided via Crux.
- Subscription: Periodic access to the Service under a recurring payment plan.
- Order: A purchase of the Service via Paddle’s checkout.
- Activation / Fulfillment: Granting you access to the Service after successful payment.

Access and Use
After completing payment via Paddle, you will be granted access or license to use the Service as per the plan you selected.
You agree to use the Service in compliance with all applicable laws, regulations, and these Terms.
You may not: reverse engineer, decompile, or attempt to extract the source code; misuse the service; abuse usage limits; infringe intellectual property rights; or use for unlawful or prohibited content.

Account, Credentials, and Security
You are responsible for maintaining the confidentiality of your account credentials (username, password).
You agree to notify us immediately of any unauthorized use or breach of security.
We reserve the right to suspend or terminate your account if we suspect misuse or violation of these Terms.

Pricing, Payment, and Taxes
The pricing plans are displayed at the checkout and within the dashboard/“Plans & Billing” section.
All payments are processed via Paddle. You may be responsible for applicable taxes (VAT, GST, etc.).
Paddle collects, remits, and reports sales taxes on your behalf.
If there is an error or dispute in billing, contact Paddle support first, and we will assist as needed.

Subscription, Renewal, and Cancellation
Unless otherwise stated, subscriptions renew automatically at the end of each billing period.
You may cancel the renewal by contacting Paddle (or via the dashboard) at least 48 hours before the next billing cycle.
Cancelling a subscription will stop future renewals; you will retain access until the end of the paid period (no refunds for unused remaining period, unless required by law).
If we change pricing for new or renewed subscriptions, we will inform you in advance; you may reject renewal by canceling before the change takes effect.

Refunds and Right to Cancel
Paddle acts as the merchant and is responsible for processing refunds.
Refund window: If you request a refund within 30 days of a one-time purchase, or 30 days from the most recent renewal of a subscription, Paddle may approve a refund at its discretion.
Refunds may be refused in cases of fraud, abuse, or other manipulations.
For digital content, once usage/download/activation begins, your statutory right to cancel may be diminished or removed under applicable law.
You agree not to request refunds directly from us; any refund must go through Paddle.
Refunds will be made via the same payment method used in the original transaction, without fees to you.

Termination or Suspension
We or Paddle may suspend or terminate access to the Service if you materially breach these Terms and fail to cure such breach within a reasonable period.
On termination, access to the Service will cease; however, any accrued but unpaid fees remain due.
Some provisions (e.g. intellectual property, liability, confidentiality) will survive termination.

Disclaimers, Limitation of Liability, Indemnity
To the maximum extent permitted by law, we provide the Service “as is” and disclaim all warranties, express or implied, including fitness for a particular purpose.
We will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Service.
You agree to indemnify, defend, and hold us harmless from any claims arising from your violation of these Terms or your use of the Service.

Intellectual Property
All rights, title, and interest in the Service (software, content, designs, etc.) remain with us or our licensors.
You receive a non-exclusive, non-transferable license to use the Service as per your subscription.
You may not copy, distribute, sublicense, or create derivative works from the Service.

Changes to Terms
We reserve the right to modify or update these Terms at any time. We will notify users of significant changes, and new versions will be effective upon posting. Continued use after changes constitutes acceptance.

Governing Law & Dispute Resolution
These Terms are governed by the laws of India.
Any dispute shall be resolved in the courts of Gurugram, Haryana, India unless otherwise required by applicable consumer protection law.
